Or, possibly, the vanish smoke could damage the opponent.

Simple. Almost every move does.

But they don't all have to oO I think it would subtract from the strategical value of the game if all of the attacks damaged.

Count the amount of moves that don't hurt enemies.
Mewtwo's Teleport. Pichu's Agility. Zelda's Transform. Shiek's Transform.
4. Yes, 4.

He needs a disadvantage somewhere, all characters have their weak point attack. Also, I thought Rare helped with DKR? oO Does this mean the other characters can be used as well? *Calls dibs on all of 'em!*

I mean that as in that, for example, Mewtwo gets farther by Teleporting than by Air Dodging, the secondary recovery move. If a move has no strategic value that can't be bought off by a similar move (in this case, Vanish vs. Side-step,) the move is rendered unnecessary and should be swiftly replaced.
Yes, but remember that the two characters that spun off their own series (Banjo and Conker) after release of the original DKR were swiftly replaced with Nintendo owned characters (Dixie and Tiny,) while all characters who only had DKR to their claim remained. As such, all DKR racers save for Banjo and Conker are First Party.
