It's just too bad that if Capcom is going to be sending over anybody they'll be sending over Mega Man. The Ace Attourney games are awesome, and Phoenix would make for such a cool character in Smash. Name: Phoenix Wright From: Gyakkutan Saiban (JP) Phoenix Wright: Ace Attourney (US) Entrance: Phoenix arrives in a police car. Special Moves: B: Take That!! Phoenix out a briefcase labeled 'evidence' and throws it forward. B Smash: Hold It!! Phoenix Points his finger forward and yells 'Hold It!!" The opponent closest to him will freeze and not be able to move until attacked. Similar to Mewtwos down B, but does not require eye contact or close range. Up B: Phoenix Flight Phoenix glows red and shoots upward. If he hits an opponent, he will grab them and slam them straight downward. Down B: Desk slam Phoenix's defense bench appears in front of him, and he slams his hands down on it. This sends shockwaves out on either side for a short distance, damaging enemys and throwing them upward. If used in the air, he'll slam the desk into the ground. Super Smash: OBJECTION!! Phoenix shouts "Objection!!", and a gigantic flaming phoenix (the bird, not him) appears and soars across the stage) Taunt: Phoenix points his finger at the screen and says "Not Guilty!" Stats: Speed: 4/5 Power: 3/5 Jump: 2/5 Fall: 1/5 Weight: 3/5 Traction: 3/5

This guy is very popular. Solid Snake got in; Phoenix Wright should at least be considered (there's Mega Man in the middle, of course). Objection!

That's what gets me, too. If it weren't for the Blue Bomber, I'm sure that Phoenix would be at the top of the list. Oh well. It's still possible, right?

I believe it is... The washed-up condition of characters that had their glory days in the distant past may lower their chances. Recent characters may be used to promote their games; I'm not sure if this is the case with Phoenix Wright: Ace Attorney.
Maybe one of the possible cons is be the difficulty of seeing an attorney fighting. Don't get me wrong; it's a minor thing, but maybe minor things matter when it comes to a reduced number of slots for 3rd party characters :/.

Phoenix for Brawl! LOL... That's a dangerous example. I was talking about Mega Man, a character we've not seen lately other than as other forms or as remakes. There must be a pattern or a rule they are wanting to use when accepting 3rd party characters. Contemporary games and fame? Memorable heroes from past games or game series? Fan requests? Good relationship between companies or personals / creators' preferences? I prefer the former two alternatives, but I don't know what way are they selecting characters.

It's probably a cross between them all. For example, Square and Nintendo always had a decent relationship, as can be seen in such games as SMRPG and Mario 3-on-3, so I wouldn't be surprised to see a Black Mage, the most memorable character from the most famous Square game, show up.
